GENERAL TERMS AND CONDITIONS OF SALE AND FABRICATION
1. DEFINITIONS AND INTERPRETATION
- “The Company” means the plastic fabrication entity, its subsidiaries, and affiliates.
- “The Customer” means the person, firm, or company purchasing Goods or commissioning Custom Work.
- “Goods” means any raw materials (sheets, rods, tubes) or fabricated plastic items supplied.
- “Custom Work” means any unique items manufactured to the Customer’s specific dimensions, prints, or designs.
2. QUOTATIONS AND ORDERS
- All written quotations are valid for thirty (30) days from the date of issue unless stated otherwise.
- The Company reserves the right to adjust pricing if the cost of raw plastic materials (such as Perspex, Polycarbonate, or Acrylic) changes drastically prior to production.
- No order for Custom Work will be processed until the Company receives a signed off engineering drawing or approval form alongside the required deposit.
3. CUSTOM DESIGN AND SPECIFICATIONS
- The Customer bears sole responsibility for the accuracy of all dimensions, specifications, and drawings provided to the Company.
- The Company accepts no liability for errors, malfunction, or structural failure resulting from flawed designs submitted by the Customer.
- Minor aesthetic modifications or variations in material thickness (subject to international manufacturing tolerances for cast and extruded plastic sheets) shall not constitute a defect or grounds for rejection.
4. PAYMENT TERMS
- Standard Orders: Payment is due in full via Electronic Funds Transfer (EFT) or card payment at or before point of collection or delivery.
- Custom Orders: A minimum non-refundable deposit of 50% is required before fabrication begins, with the remaining 50% balance due prior to dispatch or collection.
- Property and title to the Goods shall not pass to the Customer until the Company has received payment in full.
5. CANCELLATIONS AND RETURNS
- Stock Items: Unused, standard stock items (e.g., standard flat sheets or off-the-shelf acrylic brochure holders) may be returned within 7 days, subject to a 15% handling and restocking fee.
- Custom Fabrications: No cancellations, modifications, or refunds will be accepted on Custom Work or cut-to-size items once production has commenced.
6. DELIVERY, RISK, AND TRANSPORT
- Risk of damage or loss of the Goods passes to the Customer immediately upon collection from the Company’s warehouse or upon delivery by the designated courier.
- While the Company takes utmost care in packaging fragile acrylic and plastic items, it is not liable for fractures, scratches, or breaks that occur during third-party transit.
- Delivery dates are estimates only; the Company is not liable for delayed production due to material shortages, power grid interruptions, or machinery failure. [1, 2]
7. WARRANTY AND LIMITATION OF LIABILITY [1]
- The Company warrants that fabricated items will materially match the approved design and be free from structural defects in assembly workmanship for a period of 6 months.
- This warranty explicitly excludes damage caused by chemical exposure (e.g., using improper cleaning solvents on acrylic), impact damage, scratching, weathering, or misuse.
- The Company’s total liability for any defective Goods shall be strictly limited to repairing or replacing the item, or issuing a refund up to the original purchase value. The Company is not liable for any consequential loss or loss of business profits. [1, 2]
8. GOVERNING LAW
- These Terms and Conditions shall be governed by and interpreted in accordance with local commercial laws. Both parties submit to the non-exclusive jurisdiction of the local courts for any disputes arising from this agreement.
